Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of Blue Canoe’s legal suite alongside our Terms and Conditions, our Privacy Policy and our Cookie Policy. Capitalised terms not defined here have the meaning given in the Terms.

This AUP applies to all network, hosting, and mail services operated on blue-canoe.net, as well as related infrastructure and peering partners.

Blue Canoe may revise this AUP from time to time. Continued use of the Services after posting changes constitutes acceptance of the updated AUP.

General principles

Customers are responsible for their use of the Services and must not engage in activities that harm other users, our network, or third parties. Examples of prohibited activities (non-exhaustive) include:

  • Violating applicable laws, regulations, treaties, or tariffs
  • Infringing intellectual property rights
  • Violating the privacy of others
  • Deceptive or unlawful marketing practices
  • Network abuse: denial-of-service attacks; unauthorised access; introduction of malware; monitoring or scanning without permission; intercepting traffic not intended for the customer; interfering with other users’ sessions
  • Email abuse: unsolicited bulk or commercial email (spam), maintaining an open relay, harvesting addresses, providing spamware or services that facilitate spamming
  • Transmitting unlawful content or material that is obscene, threatening, harassing, defamatory, or incites violence
  • Any activity determined by Blue Canoe (acting reasonably) to be harmful to its customers, operations, or reputation

Customers providing downstream services to their own users must pass through the restrictions of this AUP contractually and maintain valid postmaster and abuse contacts, appropriate reverse DNS, and prompt response to security issues.

Where practical, Blue Canoe will notify the customer of a suspected breach and provide a reasonable opportunity to remedy it. Blue Canoe may act immediately (including filtering, suspension, or termination) in the event of severe abuse, security risk, or legal obligation.

Privacy and data

We do not routinely monitor customer communications. We may disclose information where required by law or necessary to protect the Services and other users. For details on how we handle personal data, see our Privacy Policy and Cookie Policy

Enforcement

Violations of this AUP may result in warning, filtering, rate limiting, suspension, or termination of Services, and may expose the customer to civil or criminal liability. Blue Canoe may refer matters to appropriate authorities and will cooperate with lawful investigations.
